Alibaba.com Free Sample Promotion (“Promotion”) – General Terms & Conditions (the “Official Rules”)

1.Promoter: Alibaba.com Singapore E-Commerce Private Limited, a company incorporated in Singapore with a registered office address at 10 Collyer Quay # 10-01, Ocean Financial Centre, Singapore 049315 (the “Promoter”).
2. Eligibility: Registered members of the Alibaba.com. Employees, officers and directors of the Promoter and their respective immediate family members, affiliated and subsidiary companies, any company involved in the Contest, together with their agents are not eligible to enter.
3. Terms and Conditions:

a) Registered members of the Alibaba.com may receive free samples from participating suppliers. To receive free samples, you must submit an application to the participating supplier by providing your company name, address and contact details to the participating supplier(“Application”). If your Application is successful, the participating supplier will contact you to arrange shipment of the free sample(s).

b) Applications will be evaluated by the participating supplier within ten (10) working days of submission. Participating suppliers have the sole discretion to approve or reject an Application. Free sample selection, issuance and/or distribution is determined at the sole discretion of the participating supplier. Alibaba.com is not involved in the evaluation process.
c) Each member may receive the number of free samples determined by the participating suppier for each participating product.
d) Applications with false and/or inaccurate information will not be accepted.
e) The shipping method and shipping costs of the free sample will be mutually agreed between you and participating supplier.
f ) Sample requests (such as color, size, material etc.) will not be supported.
g) No refund, exchange or issuance of an invoice will be available for free samples.
h) Participating suppliers will provide at least one (1) free sample to Identity Verified Buyers who agree to bear the shipping costs of an Application.
4.Disputes:The participant acknowledges and agrees that the Promoter or any of its affiliates shall not be responsible, and shall have no liability to it or anyone else for any dispute or claim that arises out of the participant’s participation in the Promotion.
5. General Rules:By participating in the Promotion, the participant agrees to be bound by these Official Rules.  The Promoter is not responsible for any late, lost, delayed, incomplete, illegible, misdirected or undeliverable entries, responses, or other correspondence, whether by e-mail or otherwise.  The Promoter reserves the right in it sole and absolute discretion to cancel, modify or suspend the Official Rules or the Promotion in whole or in part, without liability to the participant. The amended and restated Official Rules shall be effective immediately upon posting on the Alibaba.com website.  After posting of the amended and restated Official Rules, the participant’s continued participation in the Promotion shall be deemed to be its acceptance of the amended and restated Official Rules.  The Promoter reserves the right to disqualify any participant in its sole discretion.
6. Governing Law:You agree that this promotion is governed, interpreted and enforced by the laws of Hong Kong, without regard to its conflict of laws principles. Any and all legal actions, claims or proceedings arising out of, or in connection with this promotion must be brought in a court of competent jurisdiction in Hong Kong.
7. Disclaimer: To the maximum extent permitted by law, in no event shall the Promoter be liable to any participant for any direct, indirect, special, incidental, exemplary, punitive or consequential damages (including loss of use, data, business or profits) arising out of or in connection with the participant’s participation in the Promotion, whether such liability arises from any claim based upon contract, warranty, tort (including negligence), strict liability or otherwise, and whether or not Promoter has been advised of the possibility of such loss or damage.
