Alibaba.com Mega Sample Sale (“Promotion”) – Terms & Conditions (the “Official Rules”)

1. Promotion: During the Promotion Period, registered members of Alibaba.com may purchase limited samples from participating suppliers at a discounted price by using Secure Payment. 
2. Promoter: Alibaba.com Singapore E-Commerce Private Limited, a company incorporated in Singapore with a registered office address at 10 Collyer Quay # 10-01, Ocean Financial Centre, Singapore 049315 (the “Promoter”).

3. Promotion Period:  The promotion begins November 20, 2015 at 00:00:00 AM PST and ends November 30, 2015 at 11:59:59 PM PST (the “Promotion Period”).

4. Eligibility:  Registered members of the Alibaba.com (excluding members registered in Mainland China). Entry to this Promotion is free. Employees, officers and directors of the Promoter and their respective immediate family members, affiliated and subsidiary companies, any company involved in the Contest, together with their agents are not eligible to enter.   

5. Promotion Terms and Conditions:  

a)     The Promotion applies to selected items provided by participating suppliers in the categories Consumer Electronics, Apparel and Construction & Real Estate only.

b)     To purchase samples at a discounted price, you must place a sample order with the participating supplier and use Secure Payment to complete the order. Selection of other payment methods will not be eligible for the discount.

c)     The number of discounted samples available are limited. First come first served. If discount samples are sold out, the participating supplier may decline the order.

d)     You may only place orders for quantities of discounted samples within the sample limit per order provided by the participating supplier. Orders for quantities exceeding this limit will be rejected by the participating supplier.

e)     Each member may place one (1) sample order with a participating supplier only.

f)      Discounted sample prices exclude shipping fees.

g)     No refund or exchange an invoice will be available for discounted sample orders.  

 

6. Disputes: The participant acknowledges and agrees that the Promoter or any of its affiliates shall not be responsible, and shall have no liability to it or anyone else for any dispute or claim that arises out of the participant’s participation in the Promotion.

7. General Rules: By participating in the Promotion, the participant agrees to be bound by these Official Rules.  The Promoter is not responsible for any late, lost, delayed, incomplete, illegible, misdirected or undeliverable entries, responses, or other correspondence, whether by e-mail or otherwise.  The Promoter reserves the right in it sole and absolute discretion to cancel, modify or suspend the Official Rules or the Promotion in whole or in part, without liability to the participant.  The amended and restated Official Rules shall be effective immediately upon posting on the Alibaba.com website.  After posting of the amended and restated Official Rules, the participant’s continued participation in the Promotion shall be deemed to be its acceptance of the amended and restated Official Rules.  The Promoter reserves the right to disqualify any participant in its sole discretion.

8. Governing Law: You agree that this promotion is governed, interpreted and enforced by the laws of Hong Kong, without regard to its conflict of laws principles. Any and all legal actions, claims or proceedings arising out of, or in connection with this promotion must be brought in a court of competent jurisdiction in Hong Kong. 
9. Disclaimer: 1.      To the maximum extent permitted by law, in no event shall the Promoter be liable to any participant for any direct, indirect, special, incidental, exemplary, punitive or consequential damages (including loss of use, data, business or profits) arising out of or in connection with the participant’s participation in the Promotion, whether such liability arises from any claim based upon contract, warranty, tort (including negligence), strict liability or otherwise, and whether or not Promoter has been advised of the possibility of such loss or damage.
